Please read these Terms of Service carefully before using our website or placing an order. By accessing our site or making a purchase, you agree to be bound by these terms. If you do not agree to them, please do not use our site.

Flexx Cases ("we", "us", "our") is a trading name of Solution Express Media LLC, a limited liability company registered in the State of New Mexico.

We sell phone cases printed with original artwork, online at flexxcases.com. We sell and deliver to customers in the United States only.

2. Use of This Website

You agree to use this website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the site. You must not:

• Transmit any unlawful, harmful, threatening, or fraudulent content
• Attempt to gain unauthorized access to any part of the site, our servers, or any connected system
• Interfere with the proper functioning of the website, including by introducing viruses or malicious code
• Use automated systems to scrape, copy, or harvest content or data from the site
• Place orders using false details, or a payment method you are not authorized to use

You must be at least 18 years old, or have the permission of a parent or guardian, to place an order with us.

3. Products & Pricing

All prices are listed in US dollars and are subject to change without notice. The price you pay is the price displayed at the moment you complete your order. Where sales tax applies in your state, it is calculated and shown at checkout.

We take care to describe our products accurately. Every product page lists the material and the phone models the case fits. Please note:

• Each case is cut for one specific phone model. A case made for a different model will not fit.
• Printed colors may appear slightly different on your screen depending on your display settings.
• Our cases are made from flexible TPU. We do not claim any drop rating or protection standard that we have not tested for, and our cases are not sold as rugged or military-grade protection.

We reserve the right to modify, withdraw, or discontinue any product at any time without notice. We are not liable for typographical errors in pricing or product descriptions.

In the event of a pricing error, we reserve the right to cancel any order placed at the incorrect price. If this happens, we will notify you promptly and refund you in full.

4. Orders & Payment

By placing an order, you confirm that the information you have provided is accurate and complete, and that you are authorized to use the payment method you have chosen. You are responsible for selecting the correct phone model at checkout.

Your order is an offer to buy. A contract between us is only formed when we send you a shipping confirmation email. An order confirmation email acknowledges that we have received your order — it is not acceptance of it.

We accept the payment methods displayed at checkout and in our website footer, including major credit and debit cards.

We reserve the right to refuse or cancel any order at our discretion, including where:

• The product is out of stock or no longer available
• We suspect fraudulent activity or unauthorized use of a payment method
• There has been an error in the price or product description
• The shipping address is outside the United States, or is one we are unable to deliver to

If we cancel your order after payment has been taken, we will refund you in full.

5. Shipping & Delivery

We sell and deliver to the United States only. Orders are printed and dispatched by our third-party fulfillment partner. Delivery times are estimates and are not guaranteed. Delays may occur due to carrier issues, severe weather, or other factors outside our control.

All orders ship on a Delivered Duty Paid (DDP) basis. Any import duty or customs charge is paid by us and included in the price shown at checkout. You will not be asked to pay additional charges on delivery.

6. Returns & Refunds

We accept returns within 30 days of delivery on unused cases in their original packaging, with no restocking fee. Full details, including how to start a return and who pays return shipping, are set out in our Returns & Refunds Policy, which forms part of these terms.

Nothing in these Terms limits your rights under applicable federal or state consumer protection law, including your right to a remedy where a product is defective or materially different from how it was described.

7. Intellectual Property

All content on this website — including the artwork printed on our cases, product photography, text, graphics, logos, and page design — is owned by or licensed to Solution Express Media LLC and is protected by copyright and trademark law.

Every design we sell is our own original artwork. You may view and print pages for your own personal use. You may not reproduce, republish, distribute, print onto products, or use any of our artwork or content for commercial purposes without our express written permission.

"Flexx Cases" and our logo are trade marks used by Solution Express Media LLC. You may not use them without our written consent.

8. Device Names and Third-Party Trademarks

We name specific phone models so that you know which device each case fits. This is a statement of compatibility only.

iPhone is a trademark of Apple Inc. Galaxy and Galaxy Z Fold are trademarks of Samsung Electronics Co., Ltd. All other product names, logos and brands mentioned on this site are the property of their respective owners.

Flexx Cases is an independent brand. We are not affiliated with, sponsored by, authorized by, or endorsed by Apple Inc., Samsung Electronics Co., Ltd., or any other device manufacturer.

9. User Content

If you submit a review, photograph, comment, or any other content to our site or social channels, you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with our business.

You confirm that any content you submit is your own, does not infringe anyone else's rights, and is not unlawful, offensive, or misleading. We may remove any content at our discretion.

10. Disclaimer of Warranties

Our products are sold as described on their product pages. Except as expressly stated on this site and as required by applicable law, our products and this website are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.

Our cases are designed to hold a phone and carry a printed design. They are not a guarantee against damage to your device. We are not responsible for damage to a phone that occurs while it is in one of our cases.

We do not guarantee that our website will be available without interruption or free from errors.

11. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Subject to that, Solution Express Media LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from the use of, or inability to use, our products or website — including loss of profit, loss of business, loss of data, or damage to any device.

Our total liability to you in connection with any order shall not exceed the amount you paid for that order.

12. Termination

We may suspend or terminate your access to our website, and refuse to accept future orders from you, if we reasonably believe you have breached these Terms — for example by placing fraudulent orders, abusing our returns policy, or attempting to interfere with the site.

If you have an account with us, you may close it at any time by emailing contact@flexxcases.com. Termination does not affect any order already placed and accepted, or any rights either of us has accrued before termination.

13. Events Outside Our Control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control — including strikes, carrier failures, severe weather, or acts of government.

14. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Any changes will be posted on this page with a new "Last updated" date at the top.

The terms that apply to your order are the ones in force on the date you placed it. Continued use of the site after changes are posted constitutes your acceptance of the updated terms.

15. Governing Law & Jurisdiction

These Terms of Service, and any dispute or claim arising out of them or their subject matter, are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.

You and we both agree that the state and federal courts located in Bernalillo County, New Mexico shall have jurisdiction, except that nothing prevents you from bringing a claim in small claims court in your own state where that option is available to you.

16. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force.
